1. Interpretation and Definitions

1.1 Interpretation

Words with initial capitalization have meanings defined under the following conditions. The same definitions apply whether they appear in singular or plural.

Application (App)	The TapListen software program provided by kohuyn, downloaded on any electronic device.
Application Store	The Apple App Store, operated by Apple Inc., through which the Application was obtained.
Account	A unique account created for You to access our Service.
Developer ("we," "us," "our")	Refers to kohuyn, the individual developer of TapListen.
Content	Any text, documents, or other information that You import or access through the Service.
Device	Any device that can access the Service, including iPhone or iPad.
In-app Purchase	Any product, service, or subscription purchased within the Application.
Service	The TapListen Application and its associated backend services.
Subscription	A paid recurring service (TapListen Premium) offered via the Application.
Terms	This agreement between You and the Developer regarding use of the Service.
You	The individual using the Service.

2. Acceptance of Terms

By downloading, installing, or using TapListen ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

You represent that You are at least 13 years old. We do not permit those under 13 to use the Service.

3. Description of Service

TapListen is an iOS application that allows you to:

• Import and read PDF and TXT documents
• Listen to documents using text-to-speech (TTS) technology
• Track your reading and listening progress
• Manage a personal document library

The App provides two TTS engines:

• Apple TTS: Free, offline text-to-speech using iOS built-in capabilities
• Premium TTS (ElevenLabs): High-quality AI-powered voices available with a TapListen Premium subscription

4. Account Registration

• You may sign in using Apple Sign-In, Google Sign-In, or use the App anonymously.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information when creating an account.
• One account per person. Sharing accounts is not permitted.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions and Payments

TapListen Premium

• Premium features are available through a subscription ("TapListen Premium").
• Subscriptions are processed and billed by Apple through the App Store.
• Pricing is displayed in the App before purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

Cancellation and Refunds

• You may cancel your subscription at any time through your Apple ID account settings.
• Cancellation takes effect at the end of the current billing period.
• Refund requests must be directed to Apple, as all payments are processed through the App Store.
• We do not process payments directly and cannot issue refunds.

6. User Content

Your Documents

• You retain full ownership of all documents you import into the App.
• Documents are stored locally on your device only and are not uploaded to our servers.
• We do not claim any rights over your documents or their content.
• You are responsible for ensuring you have the legal right to access and use the documents you import.

Content Restrictions

You agree not to use the App to process documents that:

• Violate any applicable law or regulation
• Infringe on intellectual property rights of others
• Contain malicious code or are designed to disrupt the App

7. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works of the App
• Use the App for any illegal or unauthorized purpose
• Attempt to bypass subscription requirements or payment mechanisms
• Abuse the TTS API by sending excessive or automated requests
• Share, resell, or redistribute your subscription access
• Use the App to generate content that violates ElevenLabs' usage policies
• Interfere with or disrupt the App's servers or infrastructure

8. Intellectual Property

• The App, its design, code, features, and branding are the property of kohuyn.
• "TapListen" name and logo are trademarks of kohuyn.
• You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
• This license does not include the right to modify, distribute, or create derivative works.

9. Third-Party Services

The App integrates with third-party services subject to their own terms:

We are not responsible for the practices or policies of these third-party services.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• TTS audio quality will meet specific expectations (quality depends on third-party services)
• The App will be compatible with all documents or file formats
• Text extraction from PDFs will be 100% accurate

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claim related to the App shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim.
• We are not liable for any loss of data, documents, or reading progress due to device failure, App updates, or circumstances beyond our control.

12. Indemnification

You agree to indemnify and hold harmless kohuyn from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your infringement of any third-party rights
• Content you import or process through the App

13. Termination

• You may stop using the App at any time and delete your account.
• We may suspend or terminate your access if you violate these Terms.
• Upon termination, your right to use the App ceases immediately.
• Locally stored documents remain on your device regardless of account status.
• Sections 8, 10, 11, 12, and 15 survive termination.

14. Changes to Terms

We may update these Terms from time to time. Changes will be communicated by:

• Updating the "Last Updated" date at the top
• Posting notice within the App for material changes

Continued use of the App after changes constitutes acceptance. If you disagree with updated Terms, stop using the App and delete your account.

15. Governing Law

These Terms are governed by the laws of Vietnam. Any disputes shall be resolved in the courts of Ho Chi Minh City, Vietnam.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.

These terms are provided in English. In case of discrepancies with translated versions, the English version prevails.
